1. Agreement to Terms

By accessing or using Vibe Coding Academy's website, community, courses, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and Vibe Coding Academy ("we," "us," or "our"). Please read them carefully.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. Membership and Payments

4.1 Subscription Fees

Access to our community and premium content requires a paid membership subscription. The current membership fee is $97 per month ("Subscription Fee"). Prices are subject to change with notice.

4.2 Billing

Your subscription will automatically renew each month unless you cancel before the renewal date. You authorize us to charge your payment method on file for all applicable fees.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access to the Services until the end of your current billing period
  • No refunds will be provided for partial months
  • Your access to member-only content and community features will end at the conclusion of your billing period

4.4 Refund Policy

Due to the digital nature of our Services, all sales are final. We do not offer refunds for subscription payments. If you believe you have been charged in error, please contact us at support@vibecodingacademy.club.

5. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any portion of the Services
  • Use the Services for any commercial purpose without our prior written consent
  • Collect or store personal data about other users without their consent
  • Share your account credentials or allow others to access your account
  • Redistribute, resell, or share our premium content, courses, or templates

6. Intellectual Property

6.1 Our Content

All content provided through our Services, including but not limited to text, graphics, logos, images, videos, courses, templates, and software, is owned by Vibe Coding Academy or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our content for your personal, non-commercial purposes. This license does not include the right to:

  • Modify, copy, or create derivative works from our content
  • Distribute, publicly display, or publicly perform our content
  • Use our content for commercial purposes
  • Remove any copyright or proprietary notices

6.3 Your Content

You retain ownership of any content you create and share within our community. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content in connection with our Services.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will meet your specific requirements
  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Services will be accurate or reliable
  • Any errors in the Services will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE CODING ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Earnings Disclaimer

Any income or earnings statements are estimates of what may be possible. There is no guarantee that you will achieve any specific results, and your results may vary. Success depends on many factors, including your background, dedication, and effort.

We make no representations or guarantees about the effectiveness of our training, courses, or community in achieving any particular outcome. The testimonials and examples used are exceptional results and are not intended to guarantee that anyone will achieve the same or similar results.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vibe Coding Academy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or share through the Services

11. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Vibe Coding Academy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • We may delete your account and any associated data
  • Provisions of these Terms that should survive termination will remain in effect

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vibe Coding Academy operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Vibe Coding Academy regarding your use of the Services.
